Terms of Service
Effective September 1, 2026
1. Agreement
These Terms of Service govern your access to the tuneshift.ai website and any materials made available on it by TuneShift Inc, a Delaware corporation located at 8 The Green, Dover, DE 19901. By using the site you agree to these terms. Paid engagements are governed by a separate signed agreement, which controls in the event of a conflict.
2. Use of the site
You may use the site for lawful business purposes. You agree not to interfere with its operation, attempt unauthorized access, scrape it in a manner that burdens our infrastructure, or use it to develop a competing service through automated extraction of our content.
3. Services and pilots
Pilot engagements are offered at our discretion and are described in a separate written scope. Deliverables typically include an optimized engine configuration and target code for the customer's environment. Unless otherwise agreed in writing, pilots create no obligation for either party to proceed to a paid engagement.
4. Performance information
Performance figures published on this site reflect results measured on specific models, hardware, and traffic patterns. They are provided for illustration and are not a guarantee of results in any other environment. Actual outcomes depend on your workload and infrastructure.
5. Customer materials and confidentiality
You retain ownership of models, code, data, and traces you provide. You grant us a limited licence to use those materials solely to perform the services. Each party will protect the other's confidential information with at least reasonable care and use it only for the purposes of the engagement.
6. Intellectual property
The site, our brand, our methods, and our optimization tooling remain the property of TuneShift Inc. Rights in deliverables are allocated in the applicable engagement agreement.
7. Third-party components
Our work may interact with third-party software such as open-source inference engines and vendor libraries. Those components remain subject to their own licences, and we make no representations on their behalf.
8. Disclaimers
The site and any free materials are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, TuneShift Inc will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from use of the site. Our aggregate liability relating to the site is limited to one hundred US dollars.
10. Indemnity
You agree to indemnify TuneShift Inc against claims arising from your unlawful use of the site or your breach of these terms.
11. Governing law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. The state and federal courts located in Delaware have exclusive jurisdiction over disputes relating to these terms.
12. Changes and contact
